Oregonian: Man pulled head first into wood chipper sues for $16.7 million

Chouinard faults Vermeer Manufacturing for allegedly failing to make use of “readily available technology” that could have shut off the machine when his body came into contact with it, according to the suit.

According to the U.S. Occupational Health and Safety Administration, 39 workers have died in wood chipper incidents over 10 years from 1996 through 2005, the latest years from which data is available.

In Portland judge has slashed a jury’s award from $10.5 million to $500,000 for a man whose leg was severed by a garbage truck, ruling that the original amount was far more than allowed by state law for pain and suffering.

The decision – and the 2016 Oregon Supreme Court case law that prompted it – reflect a new landscape in Oregon: With few exceptions, injured people in Oregon can’t collect more than $500,000 for their emotional distress – also known as noneconomic damages – no matter how their lives have changed for the worse or how much a jury has given them.

But after waiting 16 years to first describe to The Oregonian/OregonLive the 1998 night in Corvallis when four football players, including two from Oregon State, allegedly gang raped her, Tracy is grateful for the opportunities to be heard by college athletes, administrators and coaches from Corvallis to Dallas, and Wyoming to Oklahoma.
